PHOTOGRAPHY SERVICE CONTRACT

This Photography Service Contract (Contract) is entered into between:

Services

RVisual Media agrees to provide professional photography and/or cinematography services as described below. Available service categories include:

Babies & Newborns photography
Private parties & social events coverage
Anniversaries & couples sessions
Birthdays & milestones documentation
Drone cinematography
Wedding photography

The specific services, package, date, time, and location are as recorded in Part 1 of this agreement. Any changes to the scope of services must be agreed upon in writing by both parties.

Fees & Payment

The total fee for the agreed services is as recorded in Part 1. Payment terms are as follows:

A non-refundable deposit of 30% of the total fee is required to confirm and hold the booking date.
The remaining balance is due no later than 7 days before the scheduled session date, unless otherwise agreed in writing.
Payment may be made by bank transfer, PayPal, or any other method expressly agreed upon by both parties.
Sessions will not commence until the required deposit or full payment has been received.
For bookings made within 14 days of the session date, full payment is due immediately upon booking.

Cancellation & Rescheduling

Either party may request a cancellation or rescheduling subject to the following conditions:

Client cancellations made 30 or more days before the session: deposit is forfeited; all other payments are refunded.
Client cancellations made 15–29 days before the session: 50% of the total fee is due.
Client cancellations made fewer than 14 days before the session: 100% of the total fee is due.
Rescheduling requests made at least 21 days in advance will be accommodated once without penalty, subject to availability.
RVisual Media reserves the right to cancel due to unforeseen circumstances (illness, emergency). In such cases, a full refund of all payments will be issued or an alternative date offered.

Image Delivery

RVisual Media will professionally edit and deliver the final images / footage within the timeframes below:

Standard sessions (portraits, birthdays, social events): 2–3 weeks after the session date.
Wedding & large events: 4–6 weeks after the event date.
Drone footage & cinematic edits: up to 4 weeks, depending on complexity.
Images are delivered digitally via an online gallery download link unless a physical product (album, print) has been agreed.
The number of edited images delivered is determined by the package selected and at the professional discretion of RVisual Media.

Copyright & Intellectual Property

All photographs and video footage created by RVisual Media remain the intellectual property of RVisual Media and are protected by copyright law.
The client is granted a personal, non-exclusive, non-transferable license to use the delivered images for personal purposes (printing, social media sharing, etc.).
Commercial use of any images requires prior written consent and may require an additional licensing fee.
RVisual Media retains the right to use any images from the session for portfolio, website, social media, and marketing purposes, unless the client requests otherwise in writing prior to the session.

Client Responsibilities

The client is responsible for ensuring all relevant parties (e.g., venue staff, guests) are informed of the photography session and have given their consent to be photographed.
The client must inform RVisual Media of any location restrictions, access requirements, or dress codes prior to the session date.
For outdoor sessions: the client accepts that weather conditions may affect results. RVisual Media is not responsible for adverse weather.
The client agrees to be reasonably cooperative and punctual. Significant delays caused by the client may result in reduced shooting time without a fee adjustment.

Limitation of Liability

RVisual Media will exercise all reasonable professional care. However, in the unlikely event of equipment failure, accident, or loss of media, liability is limited to a refund of fees paid for the affected services.
RVisual Media is not liable for any indirect, consequential, or incidental damages arising from the services.
RVisual Media is not responsible for delays or failures caused by circumstances beyond reasonable control (force majeure, extreme weather, acts of third parties, etc.).

Governing Law

This Contract shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts of the location of RVisual Media’s registered address.

By signing below, both parties confirm they have read, understood, and agree to the terms of this Contract and the Terms & Conditions set out in Part 3.
